The undersigned further acknowledges the fact that I, as a business invitee, have chosen of my own free will and volition to participate in the activity of driving a motorized vehicle, be the same quad or multiple wheeled motorized vehicle, on said real estate and I realize that there are inherent dangers associated from the sport and/or activity and there are inherent dangers from the equipment that I use in such endeavor, including but not be limited to, bodily injury which might occur by reason of my own activity or from the activity of other participants or from death as a result of my own activity or that of others. I further agree that as a participant I will use extreme caution and care in protecting myself and others from any accident or bodily injury which may occur from such risk. I further understand that as a part of this sport that there are inclined hills and that I am familiar with the warnings and/or instructions that might be particular to the brand and make and model of my motorized vehicle and I will not exceed any degree of inclination. I further understand that this real estate is a wooded area and I except same in its "as is condition." I further agree to indemnify and hold CRM Family Fun Trails, LLC and their heirs, executors and assigns harmless from any and all claims of loss, damages, liabilities or other expense that might arise as a result of my participation in such activity, including but not being limited to, defending any lawsuits by any of the licensees to said business, their guests or their invitees. I further understand that pursuant to Indiana Code 14-22-10-2.5 at sec there are certain statutorily provided limitations of liability that have been enacted by the Indiana Legislature and concerned a matter of public policy to grant such immunity from lawsuits and I understand the following warning which is posted on the real estate pursuant to said statute. Said warning reads as follows to-wit: WARNING Under Indiana law, an agritourism provider is not liable for an injury to, or the death of, a participant in agritourism activities at this location if the death or injury results from the inherent risks of agritourism activity. Inherent risks of agritourism activities include risks of injury inherent to land, equipment, and animals as well as the potential for you to act in a negligent manner that may contribute to your injury or death, or for other participants to act in a manner that may cause you injury or cause your death. You are assuming the risk of participating in this agritourism activity. That the person signing this Agreement states they are of adult age, sound mind, and are not under any disability or impairment that would keep them from understanding the legal importance of this Waiver of Liability. I further understand that there shall be no use or consumption of alcoholic beverages on the premises. This Release shall be binding upon heirs, executors, administrators, successors and assigns of the party to this release and this release shall not be construed against any party due to the fact that said release was drafted by CRM Family Fun Trails, LLC. * Acknowledgement I have read, fully understand and agree to the terms and conditions.
